A. Staff recommends
motion to approve: a Resolution of the Board of County Commissioners of Palm Beach County, Florida,
authorizing the issuance of general obligation bonds (workforce and affordable
housing units), in one or more series, in the aggregate principal amount not to
exceed two hundred million dollars ($200,000,000) for the purpose of financing
all or a portion of increasing workforce and affordable housing in
Palm Beach County, Florida; pledging the full faith, credit and
taxing power of the county to secure repayment of the bonds; making certain
covenants and agreements in connection therewith; authorizing the proper
officials of Palm Beach County to do all other things deemed necessary or
advisable in connection with the issuance of such bonds; providing for
continuing disclosure; authorizing the filing of a complaint of validation
pursuant to Chapter 75 of the Florida Statutes; providing for certain other
matters in connection therewith; and providing for an effective date.

A. (Cont’d) SUMMARY: On November 8, 2022, approximately 55%
of the voters of Palm Beach County approved the issuance of
Workforce/Affordable Housing General Obligation (GO) Bonds (the Bonds). The
resolution authorizes the issuance of the Bonds, in one or more series, in an
aggregate principal amount of not to exceed $200,000,000 subject to subsequent
proceedings of the Board and authorizes the County to proceed with a validation
of the Bonds. The validation procedure is a statutorily established (F.S Ch.
75) process whereby the Circuit Court determines the validity of the
authorization of the Bonds. Once the bonds are validated
in Circuit Court, staff will be able to bring an item to the Board of County
Commissioners (BCC) to authorize the initial series of bonds. The initial
series bonds would need to be issued no later than
June 2023 to allow for the approval of a millage rate during the Fiscal Year
(FY) 2024 Budget Process. The first debt service payment will
be made in FY 2024. Workforce and affordable housing units will consist
of the acquisition, construction, and equipping of condominiums, multi-family
rental units, single-family homes, and townhomes. Projects can be mixed-income
and mixed-use; however, bond financing will only be available for the eligible
housing units that meet the County requirements. Projects may
be financed by combining other funding to create rental and
homeownership opportunities for households earning up to 140% area median
income. Compliance reviews will be conducted by the County.
Staff is working with the Committee stakeholders to develop procedures for a
process to allocate bond proceeds through a Request for Proposal process. These
procedures will be presented to the BCC for approval at a
