motion to:
A) approve Agreement No. DMS-24/25-141 a Grant Agreement For Local Cybersecurity Grant Program (Agreement) with
State of Florida Department of Management Services (FDMS) through Florida
Digital Service (FDS) for assistance in the amount of $450,000;
B) delegate authority to the County Administrator, or her designee which in this case shall be
the Director of Palm Beach County Water Utilities Department (PBCWUD),
to sign all future grant agreements and supporting documents, complete all
registration requirements, future time extensions, task assignments,
certifications, and other forms associated with the grant agreement and any
necessary minor amendments that do not substantially change the scope of work,
terms, or conditions of the Agreement; and
C) receive and file the 2024 Florida Local Government
Cybersecurity Grant Application.

B. WATER UTILITIES
1. Summary: The
FDS has $40 million available for fiscal year 2024-2025 cybersecurity
technical assistance and capabilities to Florida’s local governments to improve
their cybersecurity posture and resiliency. The
awarded capabilities of Palm Beach County Water Utilities Department (PBCWUD)
include Endpoint-Based Asset Discovery (Agent); Network-Based Asset Discovery
(Agentless); Content Delivery Network; Endpoint Detection & Response (EDR);
Security Operations Platform; Email Security Solution. FDS will expend funds
for the provision of services, licenses, or commodities awarded to the PBCWUD
to be utilized for cybersecurity technical assistance purposes. PBCWUD is being
granted assistance in the form of services, licenses, or commodities to enhance
its cybersecurity framework, to identify and mitigate risks, and to protect its
infrastructure from threats. The awarded capability assistance will equate to $450,000
in savings for PBCWUD. On April 9, 2024, the Board of County Commissioners
(BCC) delegated authority to the County Administrator or her designee which in this case shall be the Director of PBCWUD, to
sign all grant application forms. The grant application was submitted April 29,
2024. In
accordance with County PPM CW-F-003, all grants executed under delegated
authority must be submitted to the BCC as a receive and file. The Risk
Management Department and County Attorney’s Office have reviewed the various indemnification
and limitation of liability requirements of the Agreement and advised staff
accordingly. Given that the County is
not responsible for FDMS’s negligence and the total liability of either party
for tort claims is limited to the amounts prescribed in section 768.28, Florida
Statutes, plus the party’s reasonable attorneys’ fees, staff recommends Board
approval. No local match is required for this grant. Countywide (MWJ)

1. Staff recommends
motion to approve: a
twelve (12) month lease agreement between the Board of County Commissioners
(BCC), of Palm Beach County, Florida, and Nations Bus Corp, a California
Corporation, for the leasing of three (3) coach bus vehicles to operate the
Port St. Lucie Express (PSL Express) Regional Transit Pilot Program, in the
amount of $396,000. Summary: The PSL Express Regional Transit Pilot Program
will connect Palm Beach County and St. Lucie County commuters using a motor
coach-style transit service and will travel north and south via I-95 providing
two (2) morning and two (2) evening trips between Gatlin Park in St. Lucie
County and the Intermodal Transfer Center in West Palm Beach. The terms and
conditions of the lease agreement shall commence and are set forth to begin on
July 15, 2024, and end on July 14, 2025. The rental amount for each vehicle is
eleven thousand (11,000) per month. The
lease can be extended up to two (2) times with twelve (12) month extensions
with a written notification of an extension request submitted at least thirty
(30) days before the current term’s maturation date. This lease agreement has
been fully funded by a Public Transportation Grant Agreement (PTGA- G2S14) with the State of Florida Department
of Transportation (FDOT). The lease of the buses requires that the County
indemnify and hold Lessor harmless from all loss and damage Lessor may sustain
or suffer by reason of Lessee’s use, maintenance or operation of the Equipment
during the applicable Term. The Risk Management Department and County
Attorney’s Office have reviewed this indemnification requirement and advised
staff accordingly. Given that liability is limited to the County’s use,
maintenance or operation of the buses for the St. Lucie Express route service
and the statutory caps of Section 768.28, Florida Statutes, staff recommends

motion to approve:
A)
Memorandum of Understanding
(MOU) between South Florida Regional Transportation Authority (SFRTA), Broward
County Transit (BCT), Miami Dade Public Works (MDPW), and Palm Tran (PT)
setting forth the required co-operation between the Agencies allowing for the
purchase of fares and the successful implementation of SFRTA’s new mobile
application; and
B)
an Application Programming Interface (API)
License and Services Agreement with Palm Tran’s contractor, Genfare, LLC, to
facilitate Genfare’s development and ongoing maintenance of SFRTA’s new mobile
application.
Summary: SFRTA has received funding form the Broward
County Metropolitan Planning Organization (MPO) for the creation of a Regional
Transit Application for South Florida.
This project, fully funded by SFRTA through the MPO will require staff time and a commitment from
each transit agency to meet the funding deadline. The mobile application will
serve as a method of purchasing other transit agency
fare media. SFRTA’s application
will transfer the user over to each agencies platform for the purchase of those fares and for processing. The API agreement will allow the regional
mobile app to leverage the Genfare Link API for Palm Tran’s Genfare Link.
The SFRTA app will use this API to allow riders who wish to purchase Palm Tran
products to create accounts, and use those products. All data for Palm
Tran transactions will remain within Palm Tran’s Genfare Link. No
personal information for riders will be shared, and credit card payments will
be processed, as they are today in Palm Tran’s system. The Risk Management Department and County
Attorney’s Office have reviewed the indemnification requirements of the API
License and Services Agreement and advised staff accordingly. Given that liability is limited to the
County’s acts and omission arising out of this agreement and the statutory caps
of Section 768.28, Florida Statutes, staff recommends Board approval. Countywide (MM)
